Excise demand of Rs.16 Crore issued to Escorts Limited

NEW DELHI. Adding to the woes of M/s Escorts Limited is the Central Excise demand to the tune of Rs. 16 Crore issued by the Central Excise Authorities Faridabad couple of days ago. Mr K.K.Jha Commissioner of Central Excise, Faridabad confirmed to Allindiantaxes about the issue of demand to Escorts.
The allegations against Escorts Limited are that they cleared parts and accessories of tractors without payment of Central Excise duty from one plant to the other.
It has also been alleged that the common PAN based Central Excise registration was inadvertently granted to M/s Escorts by the Excise department and M/s Escorts misstated the fact that their unit was just separated by a public road from their other units whereas there was a distance of about 1.5 KM between the Units and thus all the Units are to be treated as separate factories under Central Excise Act and, therefore, excise exemption for captive use is not admissible.
Escorts Group was requested to confirm the receipt of demand notice from Excise Authorities and their viewpoint on legality of demand but no response has been received till now from their end.
